Terms of Service
The agreement between you and POSCHI for using the platform.
Last updated: October 5, 2026
1. Introduction & Acceptance
POSCHI is a booking marketplace and business-operations platform operated by The Twinnovators, LLC ("POSCHI", "we", "us"). It connects clients with independent service providers and gives those providers tools to manage scheduling, payments, clients, and their team. These Terms govern your use of the website, apps, and related services.
By creating an account, booking a service, listing a business, or otherwise using POSCHI, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you are using POSCHI on behalf of a business, you confirm you are authorized to bind that business. If you do not agree, please do not use the platform.
POSCHI is a venue: the service itself is provided by the independent professional, not by POSCHI. We are not a party to the agreement for the underlying service between a client and a provider.
2. Account Registration
You must be at least 18 years old to use POSCHI. The platform is intended for adults; you may not create an account for, or direct services to, anyone under 18.
- Accurate information. Provide truthful, current details at sign-up and keep them updated.
- One account per person, one listing per business. Your account is yours and a business appears on POSCHI once. Duplicate or fake accounts, and duplicate listings of the same business, created to inflate rankings, reviews, or promotions are prohibited. One person may run more than one business from a single account, which is described in Section 14.
- Credentials. You are responsible for everything that happens under your login, including every business you run from it. Keep your password private and do not give another operator access to your account: they need their own. Staff are invited to a business rather than given your login.
- Security. Tell us immediately about any suspected unauthorized access at info@thetwinnovators.com.
3. Acceptable Use Policy
This section sets the rules everyone on POSCHI must follow. It covers the content you post, how you treat other people, and how you interact with the platform itself.
Content rules
- No profanity. Keep it clean. Offensive language may be removed and may count toward enforcement.
- No adult content. Pornographic or sexually explicit images and descriptions are not allowed.
- No graphic violence. Gore, torture, or depictions of extreme violence are prohibited.
- No hate speech. Content that attacks people based on race, ethnicity, religion, gender, sexual orientation, disability, age, or nationality is banned.
- No misinformation. Do not list false credentials, fabricate service claims, or post fake reviews.
- No spam. No mass-messaging other users, repetitive listings, or unsolicited promotions.
- No collecting health information. POSCHI is not a healthcare service. Providers must not request health information (allergies, medical conditions, medications, injuries, pregnancy, or treatment history) through intake forms, file uploads, notes, or messages. The form builder blocks forms that request it; attempting to collect health data anyway is a violation subject to enforcement, and any health information we become aware of will be deleted.
User conduct
- No harassment or stalking. Do not harass, bully, or repeatedly target other users.
- No impersonation. Do not pretend to be another business, person, or official entity.
- No threats or intimidation. Direct or implied threats toward clients, providers, or staff are prohibited.
- No doxxing. Do not share someone's private information (address, phone, etc.) without consent.
- No discrimination. Do not refuse service based on protected characteristics such as race, religion, gender, or disability.
- No fraud. No taking payment without delivering, fake bookings, or chargeback abuse.
Restricted goods
- No drugs or controlled substances. POSCHI may not be used to sell, supply, advertise, or arrange the delivery of controlled substances, cannabis, or prescription medication, whether listed as a service, an add-on, a retail product, or arranged off-platform through POSCHI's booking, messaging, or intake tools. This applies regardless of what is legal where you operate.
- No alcohol sales. POSCHI may not be used to sell alcohol or to take payment for it. POSCHI verifies no one's age at the point of sale and is not a licensed alcohol retailer, so alcohol may not be listed as a service, product, or add-on even if you hold a licence to sell it in person.
Selling drugs or alcohol through POSCHI is treated as a severe violation. Accounts found doing it are suspended immediately, without a prior warning and without the tiered enforcement ladder in Section 12, and may be referred to law enforcement.
Platform integrity
- No fake reviews. Leaving, buying, or soliciting fake ratings or testimonials is prohibited.
- No unauthorized access. Do not attempt to reach other users' accounts, data, or admin tools.
- No scraping or bots. Automated data extraction, scraping, or reverse-engineering of the platform is not allowed.
- No account sharing. Your login is yours. Do not give it to anyone else, and do not use somebody else's. Running several of your own businesses from one account is permitted and is described in Section 14; handing your credentials to another operator is not.
4. Content Rules
You own the content you upload, photos, service descriptions, agreements, intake forms, and messages, and you are responsible for it. By posting, you grant POSCHI a non-exclusive, worldwide, royalty-free license to host, display, and use that content to operate and promote the platform (for example, on your public profile and in search results). You confirm you have the rights to everything you upload.
Your representations and warranties
The sentence above said you confirm you have the rights. This sets out what that means, because "you have the rights" is the part people assume rather than check, and an image taken from a search results page is the commonest way a business gets a letter from a photographer.
By submitting, posting, or uploading any image or other content to POSCHI, you represent and warrant that:
- You own it, or you have permission. You own all rights to the images, or you have express, legal permission from the copyright owner to post them here. A photograph taken by somebody else is theirs, including one taken of your own work by a photographer you hired, unless your agreement with them says otherwise.
- It infringes nobody. The content does not violate any third-party copyright, trademark, privacy, or publicity rights. A recognisable person in a photograph has rights in their own likeness, so do not publish a client without their permission.
- You license it to us. You grant us a non-exclusive, royalty-free license to display and host this material on the platform, for as long as you keep it here.
We do not check whether you hold those rights, and we want to be plain about why rather than let the absence look like an oversight. No tool can tell that an image is yours: a reverse image search shows where a picture has appeared before, not who owns it or who has bought a licence to use it. So this is a promise you make, we act on what we are told, and if somebody tells us otherwise we take the material down.
Right to remove
We reserve the right to delete any uploaded image, or any other content, at any time and for any reason, without warning. In practice we remove things that break these Terms or that somebody has reported, and we will normally tell you when we do. This reserves the right, it does not describe an intention.
These are the grounds we act on. Every removal is recorded against one of them, so this is the whole list rather than a sample, and it is the same list the reviewer chooses from. Some carry criminal weight and are reported onward where the law requires it.
- Minor safety. Sexualized, nude, exploitative or otherwise inappropriate imagery involving a minor, and any sexual content involving someone under 18.
- Non-consensual imagery. Intimate or private imagery posted without consent, including hidden-camera images, upskirting, altered intimate images, and private photographs shared by somebody else.
- Illegal activity. Content that depicts, promotes, facilitates or instructs unlawful conduct, including drug sales, fraud, stolen goods, exploitation and criminal threats.
- Threats or dangerous conduct. Threatening, intimidating or violent imagery, including weapon-based threats and content promoting violence.
- Violence. Graphic violence, gore, disturbing injury imagery, dead bodies, violent assaults, and imagery glorifying harm.
- Hate or discrimination. Hateful, discriminatory, extremist or dehumanizing imagery, including hate symbols, racist caricatures and attacks on protected groups.
- Self-harm or harmful conduct. Graphic or promotional imagery involving self-harm or suicide, dangerous challenges, and unsafe medical or beauty practices presented as normal.
- Sexual content. Nudity or sexually explicit content, including pornographic imagery, visible genitalia, sexual acts and sexually exploitative imagery.
- Privacy violation. Visible personal or sensitive information, including identity documents, addresses, phone numbers, payment cards, medical records, passwords and booking details.
- Harassment or bullying. Imagery intended to shame, humiliate, target or intimidate somebody, including embarrassing photographs posted without consent and manipulated images meant to degrade.
- Impersonation or deceptive identity. Images that falsely represent a person, business, service, credential or affiliation, including stolen headshots and fake certifications.
- Malicious or unsafe file. Files that fail technical or safety validation, including suspected malware, a misleading file type, corrupted content or a disallowed format.
- Prohibited goods or services. Images promoting goods or services POSCHI does not permit, including illegal goods, weapons, controlled substances, sexual services and counterfeits.
- Copyright or IP infringement. Content used without the rights to use it, including another provider's work, a photographer's images, campaign imagery and misleading use of a logo.
- Fraud or misrepresentation. Images that materially misrepresent a provider, service, result, price, credential or outcome, including stock or AI-generated images presented as real work.
- Scam or spam. Promotional, irrelevant, manipulative or repetitive media, including unrelated advertising, affiliate promotions and misleading discount claims.
- Off-platform contact circumvention. Images that try to bypass POSCHI booking, payment or safety processes, such as prominent phone numbers, payment handles, external booking links or QR codes.
- Platform integrity. Content that disrupts or exploits POSCHI, including fake POSCHI notices, screenshots of internal tools, instructions for evading moderation, and abusive use of POSCHI branding.
- Other policy violation. A policy breach that does not fit any heading above. A reviewer using this one has to write down what it was.
Removal is not always permanent deletion. An image may be hidden while it is looked at, which is reversible, or removed and kept privately for a retention period so that an appeal or a counter-notice can be answered, before it is deleted for good. Where we never hosted the file, because it was loaded from another website, we can only unlink it here; it continues to exist wherever it actually lives.
Keep your own copy of anything you care about. POSCHI is where your portfolio is shown, not where it is stored for safekeeping.
We may remove content that breaks these Terms or our Acceptable Use Policy. Content is reviewed by people, usually after somebody reports it, rather than screened automatically when you submit it. The exception is health information in intake forms, which the form builder blocks outright. We may introduce automated screening in future.
Copyright complaints (DMCA)
POSCHI hosts material uploaded by its users. If you own a copyright, or are authorised to act for someone who does, and you believe material on POSCHI infringes it, send a notice to our designated agent at the address below. We respond to complete notices by removing or disabling access to the material, and we tell the person who posted it.
Your notice must include all of the following:
- Your signature. Physical or electronic, from you or someone authorised to act for the copyright owner.
- The work. Identification of the copyrighted work you say has been infringed.
- The material. Identification of what is infringing and where it is on POSCHI, specific enough for us to find it. A link is best.
- Your contact details. Address, telephone number, and email address.
- A good-faith statement. That you believe the use is not authorised by the copyright owner, its agent, or the law.
- A statement of accuracy. That the information in your notice is accurate, and, under penalty of perjury, that you are authorised to act for the copyright owner.
A notice missing any of these is not effective and we may not act on it. Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. 512(f), so please be sure before you send one.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same agent. It must include your signature, identify the material and where it appeared, state under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification, and give your name, address and telephone number together with your consent to the jurisdiction of the federal court for your district, or for Gwinnett County, Georgia if you are outside the United States, and your agreement to accept service from the person who complained.
If we receive a valid counter-notice we forward it to the original complainant. Unless they tell us within 10 business days that they have filed a court action to restrain the activity, we may restore the material.
Repeat infringers
We terminate the accounts of repeat infringers in appropriate circumstances, under the enforcement ladder in Section 12.
Designated agent
Copyright Agent, The Twinnovators, LLC.
Email: info@thetwinnovators.com
Copyright notices are received by email at the address above.
We are not currently registered with the United States Copyright Office as a designated agent, so the safe harbour at 17 U.S.C. 512(c) is not available to us. We follow the process set out above regardless, and it is the fastest way to have infringing material taken down. Nothing here waives any right either of us has.
This address is for copyright notices only. Anything else sent here, including general support and abuse reports that are not about copyright, will not be answered. Use Report Abuse for those.
5. Intellectual Property & Your License
The POSCHI name, logo, software, and design are owned by us and protected by intellectual property law. You may not copy, modify, or reuse them without permission.
Your license to use POSCHI
For as long as your account is open and in good standing, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use POSCHI through the interfaces we provide, for your own business or personal use. That includes installing POSCHI to your device where we offer it as an installable app. This is permission to use the platform, not a transfer of it: we keep every right we have not expressly granted here.
Staff you invite through the platform may use POSCHI under the seats assigned to your business. Beyond that, you may not resell, rent, sublicense, or operate POSCHI as a service for anyone else, and you may not copy, modify, translate, or build derivative works from the platform or its underlying software. The platform-integrity rules in Section 3 apply here too: no scraping, no automated extraction, and no reverse engineering.
Booking widget and embed code
If you use the booking widget, we grant you a license to embed the code we generate, in the form we generate it, on websites you own or control, for the purpose of taking bookings for your own business. Do not alter the embed code, use it to load POSCHI content into another product, or present it as your own software. We may change, update, or discontinue the widget at any time, including for security reasons, and a change may require you to update the code on your site.
When this license ends
The licenses in this section end when your account closes or is suspended under Section 11. At that point you must stop using the platform and remove any embed code from your websites. Two related things are covered elsewhere: what happens to the content you uploaded is in Section 11, and the separate license you grant us over that content is in Section 4.
Respecting other people's rights
- No copyright infringement. Do not upload logos, photos, or brand assets you do not have the rights to use.
- No trademarked branding. Do not use another company's logo or brand name in your listings without permission.
- No unauthorized use of client data. Providers may not repurpose client contact information for marketing outside of POSCHI's own tools.
6. AI-Generated Content
POSCHI does not generate images or text for you. There is no tool on the platform that writes your copy or makes your pictures, and nothing you upload is altered by one.
What POSCHI provides is a label. If you publish imagery that was generated or enhanced by AI elsewhere, for example in a portfolio or lookbook, you must mark it with the platform's AI label so clients are not misled about real results. Do not present AI-generated work as a photograph of an actual service you performed, and do not publish misleading, deceptive, or infringing content, AI-assisted or not. You remain responsible for anything you publish.
Separately, some promotional images and videos on POSCHI's own website are generated or enhanced using AI. They do not depict real clients, providers, or results, and they are disclosed as such where they appear.
7. Payments & Refunds
When you book, you authorize POSCHI and its payment processor to charge your payment method for any deposit, balance, no-show fee, or tip according to the provider's published policies. The total amount of each charge is recomputed by POSCHI at the time of payment from the underlying booking or invoice, any client-supplied amount is ignored, so the price you see is the price you pay. Cancellation, rescheduling, and refund rules are set by each provider and shown on the booking page before you confirm. Autopay agreements create recurring charges on a schedule both parties approve; either side can pause or cancel.
Payment processors. POSCHI processes payments through Stripe and Square, whichever a business connects. PayPal is planned as an additional option and is not yet active; we will update these Terms before enabling it. Card details are tokenized by the payment processor and never stored on POSCHI's servers.
Refunds. For our initial launch, refunds are issued by the provider directly through their Stripe dashboard, following the cancellation policy shown to the client at booking. POSCHI surfaces a read-only list of refundable transactions with a deeplink to the processor dashboard, and syncs the refunded state back to your booking once the processor confirms it. Chargeback outcomes are decided by the card network and processor, not by POSCHI.
Subscriptions. Providers pay a subscription for their plan plus standard processing fees on transactions. Trials and grace periods are described on the pricing page; if a subscription lapses, the account may be temporarily limited (read-only) before further restrictions apply. We will give providers at least 30 days' notice before any subscription price change. If you run more than one business, each carries its own subscription and each is billed, renewed and cancelled on its own. See Section 14.
Marketplace fee. Separately from the subscription, POSCHI charges the provider a percentage of the first booking each new client makes with them. The current rate is shown on the pricing page. The fee is deducted automatically when the payment is processed, so the provider's payout is the amount paid by the client less this fee. We will give providers at least 30 days' notice before any change to this rate.
Card processing. Payments made through POSCHI are charged to POSCHI by the payment processor, and POSCHI deducts that cost from the payout. On a booking that carries the marketplace fee above, the marketplace fee covers processing and nothing further is deducted. On every other booking, including a returning client's, POSCHI deducts an amount equal to the processing cost, currently 3.1% of the payment plus 30 cents. The two are never both taken: the deduction is whichever of them is larger, and it is never more than the payment itself.
Staff seats. Each plan includes a number of staff seats and permits a maximum. Seats beyond those included are billed monthly at the rate shown on the pricing page, and are charged for as long as the seat exists rather than per booking.
Mobile services. If you book a service where the provider travels to your location, you'll be asked for an address and a phone number so the provider can reach you on the way. The provider sees that information only for the booking it relates to.
Rentals & security deposits
Some providers offer rentals, where you reserve an item, space, or equipment for a range of dates or hours rather than a single appointment. When you book a rental you authorize a deposit now and agree that the remaining balance is due at the start of the rental, in each case per the provider's published pricing and policy shown before you confirm.
Security deposits. A rental may require a refundable security deposit collected at checkout in addition to the rental deposit. The security deposit is intended to be returned to you after the item is returned on time and in the condition you received it. A provider may withhold or deduct from the security deposit for late return, loss, theft, or damage beyond normal wear, in line with the rental terms shown at booking. Any amount owed above the security deposit for loss or damage remains your responsibility.
Your responsibilities. While a rented item is in your possession you are responsible for its safekeeping, lawful use, and timely return, and you agree to return it in the same condition, ordinary wear excepted.
POSCHI's role. POSCHI facilitates the booking and payment for a rental but is not the owner, lessor, or a party to the rental itself, and does not inspect, insure, or guarantee any rented item. The rental agreement is between you and the provider. Disputes over condition, return, or a security deposit are resolved between you and the provider under the provider's policy; POSCHI may help mediate through its dispute process but does not decide damage or forfeiture outcomes.
8. Text Messages
Message and data rates may apply. Message frequency varies by the messages you choose. Consent is not a condition of booking or of any purchase. Reply STOP to cancel at any time, or HELP for help.
The messaging program is POSCHI, operated by The Twinnovators, LLC. For help with text messages, reply HELP to any message or write to info@thetwinnovators.com.
POSCHI sends text messages only to a number whose owner has agreed to receive them. Consent is given by ticking a box that states what the messages are, and is recorded against the phone number together with the exact wording shown and the time it was agreed. Agreeing is never a condition of booking, of buying anything, or of using POSCHI.
- What you receive. Clients who opt in on the booking form receive a booking confirmation, reminders, and notice of any reschedule or cancellation. Businesses who opt in from their account settings receive an alert when a client books, cancels or reschedules with them. Promotional messages are a separate opt-in and are off unless you switch them on.
- Stopping them. Reply STOP to any message. That ends every kind of message to that number, immediately and permanently, and withdraws the consent record rather than merely pausing sends. Reply HELP for help, or write to us at the address at the end of this document.
- Frequency and cost. Appointment messages follow your own bookings, so their frequency is whatever your booking activity is. Promotional messages are occasional. Message and data rates may apply, and those are between you and your carrier.
- Your number, your responsibility. Give us a number you control, and tell us if it changes. Consent belongs to the number rather than to the account, so a number you give up stops being yours to consent for, and a new number has not consented until you say so.
- Delivery is not guaranteed. Carriers filter, delay and drop messages for reasons outside our control. A text is a convenience and is never the only place we tell you something that matters. Carriers are not liable for any delayed or undelivered messages.
Push notifications
Push notifications reach your browser, or POSCHI added to your home screen, without needing a separate app. POSCHI sends them only to a device whose owner has turned them on. Permission is asked for only after you tap to turn them on, never when a page loads, and what you agreed to is recorded together with the wording you were shown and the time you agreed. Agreeing is never a condition of booking, of buying anything, or of using POSCHI.
- What you receive. Notice of a new booking, a confirmation, a change or a cancellation, and the same alerts you would see inside POSCHI. Promotional notifications are a separate choice and are off unless you switch them on.
- Per device, not per account. Permission belongs to the browser on the device you granted it from. Turning notifications on using your phone does not turn them on for your laptop, and turning them off on one device leaves the others as they are.
- Stopping them. Turn them off in your POSCHI notification settings, which removes that device and withdraws the consent record rather than merely pausing it. You can also revoke permission in your browser's own site settings at any time, with or without telling us.
- What is in them. A short title and a line of text, and a link to the screen it is about. We keep payment details and private notes out of them, because a notification can appear on a locked screen that someone else is looking at.
- Delivery is not guaranteed. A push passes through a service run by your browser's maker, which may filter, delay or drop it for reasons outside our control, and a device that is off or offline may never receive it. A notification is a convenience and is never the only place we tell you something that matters.
9. Disclaimers & Liability
No warranties
POSCHI is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the platform will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected.
Services are provided by providers, not by POSCHI
POSCHI is a venue. We do not perform, supervise, direct, inspect, or control any service booked through the platform, and we do not employ providers or their staff. We do not guarantee the quality, safety, legality, or outcome of any service, and we do not verify licenses, certifications, insurance, or qualifications beyond what a provider chooses to state.
You book and receive services at your own risk. To the maximum extent permitted by law, you release POSCHI from claims, demands, and damages arising out of or connected to any dispute, interaction, service, or rental between you and a provider, a client, or any other user, including bodily injury, illness, allergic reaction, property damage, theft, or loss.
Platform-specific disclaimers
- Notifications. Reminders, confirmations, and other messages may be delayed, undelivered, or filtered by a carrier, network, or mail provider. They are a convenience, not a guarantee, and they do not replace your own record-keeping. You remain responsible for your appointments.
- Your data. Keep independent copies of anything you cannot afford to lose. We are not liable for the loss, corruption, or unavailability of content, bookings, client records, or business data.
- Payments. Card authorizations, settlements, payout timing, chargebacks, and refunds are handled by our payment processor and the card networks. We are not liable for their acts, omissions, delays, or decisions.
- Rentals. We are not the owner or lessor of any rented item, and we do not inspect, insure, or guarantee it. Condition, return, damage, and security-deposit outcomes are between you and the provider.
- Third parties. Integrations, calendars, and linked sites are operated by others and are outside our control.
Damages we are not liable for
To the maximum extent permitted by law, POSCHI is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost bookings, lost data, lost goodwill, or business interruption, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages. This applies even if a remedy in these Terms is found to have failed of its essential purpose.
Cap on liability
In no event shall POSCHI's total aggregate liability for all claims relating to the platform exceed the greater of (a) the fees you paid to POSCHI for its own services in the twelve months before the event giving rise to the claim, or (b) USD 100. Amounts POSCHI collects on a provider's behalf and remits to them, and third-party payment-processing fees, are not fees paid to POSCHI for its own services and do not increase this cap.
This cap does not apply to liability for fraud, gross negligence, or willful misconduct, to death or personal injury caused by POSCHI's own negligence, or to any liability that cannot be excluded or limited under applicable law. Some states do not allow certain exclusions or limitations, so parts of this section may not apply to you, and nothing here limits rights you have under your local consumer-protection law.
Time limit on claims
Any claim relating to the platform must be brought within one year after it arises, to the extent that limit is permitted by applicable law. Otherwise it is permanently barred.
10. Indemnification
You agree to indemnify, defend, and hold harmless POSCHI, The Twinnovators, LLC, and their officers, members, employees, and agents from and against any claim, demand, investigation, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or connected to:
- Your use of the platform. Your access to or use of POSCHI, or anyone else's use through your account.
- Your content. Anything you upload, publish, or send, including photos, listings, agreements, intake forms, reviews, and messages, and any claim that it infringes someone's rights.
- Your services. For providers, the services, rentals, products, or advice you deliver, and any injury, illness, damage, or loss connected to them.
- Your breach. Your violation of these Terms, the Acceptable Use Policy, or any law, including licensing, employment, consumer-protection, tax, and privacy law.
- Health information. Any health information you request, collect, or store through POSCHI in breach of Section 3, and any claim arising from it.
- Your disputes. Any dispute between you and another user.
We may assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with that defense. You may not settle a matter that imposes any obligation on POSCHI without our prior written consent. This section survives termination of your account.
11. Your Data & Deletion
How we collect and use personal data is described in our Privacy Policy, which forms part of these Terms.
Storage limitation. We keep personal data only for as long as it is needed for the purpose it was collected for, and no longer. When that purpose ends, the data is deleted or de-identified.
Deletion. You can request deletion of your account and personal data at any time from Account, Data & Privacy, or by emailing info@thetwinnovators.com. We will erase your personal data within 30 days of the request, except where we are required to retain specific records by law, for example transaction and tax records, or where we must keep them to resolve a dispute, prevent fraud, or enforce our agreements. Anything retained on those grounds is limited to what the obligation requires, and is deleted once it expires. Residual copies in backups roll off within about 35 days.
12. Termination & Enforcement
You may close your account at any time from Settings. We may warn, restrict, suspend, or permanently remove accounts that violate these Terms or the Acceptable Use Policy.
We generally apply a tiered enforcement ladder:
- Warning, for first-time, minor violations.
- Content removal, the offending listing or media is taken down.
- Temporary suspension, for repeated or moderate violations.
- Permanent ban, for severe or repeated serious violations.
- Legal referral, criminal activity may be reported to the authorities.
Serious violations, fraud, threats to safety, the sale of drugs or alcohol through the platform, or illegal activity, may result in immediate suspension without prior warning. Suspended providers are notified that their public listing has been hidden pending Trust & Safety review and may continue to manage existing bookings while we review. Provider listings hidden in this state do not appear in public search, category, or city pages.
Reporter confidentiality & anti-retaliation
When you report someone, we treat your identity as confidential and do not share it with the reported user. We also do not reveal the specific allegation or category to them. We acknowledge that a review is underway without disclosing details that could enable retaliation. Patterns of low-severity reports against the same provider are automatically flagged for human review (they do not automatically suspend, to prevent coordinated false reports from weaponizing the system).
You can report a violation any time at our Report Abuse page or by emailing info@thetwinnovators.com.
Legal & compliance
- Follow the law. Providers must hold any licenses or certifications their trade requires.
- No illegal services. Listings for unlawful activities are removed immediately.
- No drug or alcohol sales. POSCHI is not a licensed retailer of alcohol or of any controlled substance and verifies no one's age at the point of sale. Selling either through the platform, in any form, results in immediate suspension. See Section 3.
- Tax compliance. Users are responsible for collecting and reporting any applicable taxes on services rendered.
- Data privacy. Do not collect or store client personal data outside of what POSCHI's system provides.
- Age restriction. POSCHI is for users 18 and older; services may not target minors.
13. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules.
Informal resolution first. Before starting a formal proceeding, contact us at info@thetwinnovators.com and give us 30 days to resolve the matter.
Please read this part carefully. It affects how disputes between you and POSCHI are resolved, and it limits your right to bring a claim as part of a class.
Binding arbitration. If the informal step above does not resolve matters, any dispute arising out of or relating to these Terms or your use of POSCHI will be settled by binding arbitration rather than in court, administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Gwinnett County, Georgia. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitrator decides the dispute, and may award the same individual relief a court could; questions about whether this section itself applies are for a court, not the arbitrator.
Class-action waiver. You and POSCHI each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of more than one person or preside over any form of representative proceeding. If this paragraph is found unenforceable as to a particular claim, that claim, and only that claim, is severed from arbitration and proceeds in court; the rest of this section survives.
Jury trial. Both of us give up the right to a trial by jury for anything covered by this section.
You can opt out, and it costs you nothing. Arbitration is not compulsory. Email info@thetwinnovators.com within 30 days of first accepting these Terms, with your name and the address on your account, saying you opt out of arbitration. That is the whole process. Opting out affects nothing else: it does not change your access, your pricing, or how we treat you, and the rest of these Terms still applies.
Fees. AAA's Consumer Arbitration Rules decide who pays what. Where those rules make you responsible for a filing fee that is more than it would cost to file the same claim in a Georgia court, we pay the difference. Each of us otherwise bears our own legal costs unless the arbitrator decides differently.
Claims brought in bulk. If 25 or more people bring materially similar claims represented by the same or coordinated counsel, the cases may be batched by AAA into groups of up to 50 and resolved in sequence, with the outcome of the first group informing the rest. Any limitation period is paused for claims awaiting their batch.
What is left out. Either party may still bring an individual claim in small-claims court, and either party may ask a court for an injunction to stop infringement or misuse of intellectual property. For any dispute not subject to arbitration, and for enforcing an arbitration award, you and POSCHI consent to the exclusive jurisdiction and venue of the state and federal courts located in Gwinnett County, Georgia. Nothing in this section limits rights you may have under your local law, and nothing in it prevents you from reporting a concern to a government agency.
We may update these Terms from time to time. For material changes we will notify account holders by email and in-app at least 14 days before they take effect. Continued use after that date means you accept the updated Terms. Questions? Email info@thetwinnovators.com.
14. More Than One Business Under One Account
POSCHI lets one login own more than one business. Each business is a separate workspace with its own services, clients, staff, calendar, media, payouts and subscription, and you move between them with the switcher in your profile menu. This section sets out what that means for the agreement between us. Where it differs from anything earlier in these Terms, this section governs.
Who is agreeing
The account is yours. Every business created under it is created by you and operated by you, and you are responsible for all of them, including anything done by staff you invite to any one of them. Where a business is a separate legal entity, you confirm you are authorised to bind that entity when you create it, and these Terms apply to that entity as well as to you. Adding a second business does not create a second account, a second agreement, or a second contracting party.
This is not account sharing, which is still prohibited. The rule in Section 3 is about people: your login is yours, and another operator running their own business needs their own account. One person running several businesses from one login is what this section permits. Several people sharing one login is not.
How many
How many businesses you may have depends on your plan. The number each plan allows is shown on the pricing page and enforced by us when a business is created, and it moves with your plan: if you change to a plan that allows fewer businesses than you already have, we will not delete anything, but you will not be able to add another until you are within the new limit.
Each business pays for itself
- A subscription each. Every business carries its own subscription at its own plan and price. They are billed separately and they renew separately. Paying for one does not pay for another.
- The free trial is for your first business only. Any free trial applies to the first business on your account. A business added afterwards begins billing when you choose its plan, with no trial period, and this is shown to you before you create it.
- Cancelling one cancels one. Cancelling, pausing or letting a subscription lapse affects only the business it belongs to. Your other businesses carry on and remain payable. Closing your whole account is a separate thing and ends all of them.
- Lapsing has its own consequences, per business. The limits that apply to an unpaid subscription, described in Section 7, apply to the business that did not pay and not to the rest.
The linked-business discount
A business added to an account that already has a paying business receives a percentage off its own subscription. The percentage is shown to you before you choose that business's plan and is applied to the published price, including the annual price where you pay annually. It is a billing term rather than a promotion, and it works like this:
- It depends on your first business paying. The discount exists because your first business is on a paid subscription. If that subscription is cancelled, lapses, or otherwise stops being active or in trial, the discount ends.
- It ends at the next renewal, not immediately. We do not re-price a period you have already been billed for. When the discount ends it ends from the following renewal, and the business is charged its full published price from then on.
- It is not granted while you are leaving. If your first business has been cancelled but is still running to the end of its period, a discount already in place continues to the end of that period, but a business added during it does not receive a new one.
- One discount at a time. Where more than one discount could apply to the same subscription, we apply whichever is worth more to you rather than both.
Your businesses are separate from each other
Nothing is shared between two businesses on the same account. Clients, bookings, services, pricing, staff and their permissions, locations, media, reviews, payouts and billing history all belong to the business they were created in and are not visible from another, including to staff. Creating a business does not copy anything into it: it starts empty. We do not merge businesses, and there is no way to move records between them.
Staff you invite to one business have access to that business only. Inviting the same person to a second business is a separate invitation with its own permissions.
For clarity, this separation is between your businesses. It does not change what these Terms and the Privacy Policy say about how POSCHI itself handles your data, and we may use information across your account for billing, fraud prevention, support and enforcement.
Enforcement across your businesses
A violation is normally dealt with where it happened, and the enforcement ladder in Section 12 applies to that business. But the account is yours and so is the conduct: where a violation is serious, repeated, or an attempt to carry on elsewhere something we have already stopped, we may apply enforcement to any or all of the businesses under your account, and to the account itself. Creating another business to continue conduct we have acted on is itself a violation.
Closing one business
You can cancel a business's subscription yourself. Removing a business and its data entirely is not something you can do from the app today, so write to us at info@thetwinnovators.com and we will handle it as a deletion request under Section 11 for that business. Deleting one business does not close your account or affect the others, and the retention rules in Section 11 apply to it in the same way.
